Terms of Service

These terms govern your use of ABITECH Kazi, a staffing introduction service operated by ALF Holdings East Africa Limited (Company Reg. No. CPR/2012/90232), Ikigai Offices, Merchant Square, Riverside Drive, Nairobi, Kenya. By messaging us on WhatsApp you agree to these terms.

This is a plain-language baseline. ALF Holdings should have these terms reviewed by Kenyan legal counsel before relying on them as a final contract.

1. What we do

We introduce verified workers (security guards, house help / nannies, cleaners and hospitality staff) to employers and households in Nairobi. We are an intermediary: we are not the employer of the workers we introduce, we do not supervise their work, and a placement creates an employment relationship directly between the employer and the worker.

2. Our regulatory status

We introduce workers to employers within Kenya only and do not recruit for employment outside Kenya. We are not yet registered with the National Employment Authority (NEA); registration under the National Employment Authority Act is required of an agency that charges a placement fee, and is in progress. We are not licensed by the Private Security Regulatory Authority (PSRA) — we introduce guards to employers, we do not supply guarding services and we do not employ guards. Employers hiring security staff remain responsible for their own obligations under the Private Security Regulation Act, 2016.

5. Placement fee

Our placement fee is 50% of the worker's agreed first month gross salary, or the minimum for the role, whichever is higher. There is no other charge: no registration fee, no shortlist fee, no monthly fee.

Example: a guard on KES 30,000 per month costs a fee of KES 15,000. A guard on KES 20,000 per month costs the KES 12,000 minimum. You are shown the exact amount in writing before any payment is requested.

6. When and how you pay

The placement fee is payable in advance: you confirm the candidate and the agreed salary, we send an M-Pesa PIN prompt straight to your phone, and the worker's start date is confirmed once the fee has been received. We do not release a worker's full contact details before the fee is settled.

Payment is in Kenyan Shillings. A partial payment does not confirm a placement; it is held and flagged until the balance is received or refunded.

7. Replacement guarantee — 60 days

If a worker we introduced leaves or is dismissed for cause within 60 days of the agreed start date, we will find a replacement for the same role at no additional placement fee. The guarantee applies when all of the following are true:

The guarantee covers one replacement per placement and is not exchangeable for a refund. It does not apply where the role is cancelled, where the employer no longer needs the position, or where the worker leaves because the agreed terms were not honoured — in that last case we will discuss the matter with you directly.

8. Going around us

If you hire a worker we introduced to you — or introduce them to another employer who hires them — within six months of that introduction, the placement fee for that role remains payable, whether or not the hire was arranged through our WhatsApp conversation. This clause exists because our only income is the placement fee; it is not intended to restrict any worker, who is always free to take any job they wish.

9. Verification & disclaimer

We verify workers to a reasonable standard. Every worker's national ID photograph is reviewed by a member of our team before they can be matched to you. A Certificate of Good Conduct, a Guard Force Number for security roles, and reference calls are recorded per worker where we hold them, and we tell you which of these we have for anyone we introduce. We cannot guarantee future conduct or performance. Employers remain responsible for their own hiring decisions and for any checks the law requires of them.

10. Liability

To the extent permitted by law, our liability in connection with a placement is limited to the placement fee paid for that placement. We are not liable for indirect or consequential loss, nor for the acts or omissions of a worker once employed by you.

11. Data protection

We handle personal data in line with our Privacy Policy and Kenya's Data Protection Act, 2019. Identity photographs are deleted after verification — see section 5 of that policy.

12. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

13. Changes & contact
